Petitioner is languishing in custody for the offences punishable under Sections 304(B), 498(A) and 34 of the Indian Penal Code.
Petitioner is the husband of the victim lady. He is in custody since 14.06.2016. Allegation is that death for dowry was committed within seven years of marriage in the matrimonial house of the victim, Manti Devi.
Submission is that the victim committed suicide. The case diary reveals that other independent witnesses have also supported the allegation of demand of dowry and torture. Considering the aforesaid material, I am not
Patna High Court Cr.Misc. No.15627 of 2017 (3) dt.08-05-2017 2/2 inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail in connection with S. Tr. No. 416 of 2016 arising out of Agiaon Bazar P.S. Case No. 15 of 2016 pending in the court of learned 6th Additional District Judge, Bhojpur, Ara is refused. The trial court is directed to expedite and conclude the trial within nine months from the date of receipt of a copy of this order, failing which the petitioner would be at liberty to renew his prayer for bail.
