The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the five named accused persons including the petitioner herein as also 6-7 unknown persons entered into the house of the informant variously armed. It is stated that accused Ravi Kumar @ Achhwa shot at the brother of the informant with a pistol who on being taken to the hospital was declared dead.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in the case. Although

Patna High Court CR. MISC. No.22132 of 2021(2) dt.07-10-2021 2/2 his name finds mention in the F.I.R, however no overt act has been alleged against him. He is in custody since 2.7.2020 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Kankarbagh P.S. Case no.457 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Patna.
