2. In the present case, the petitioner seeks bail in connection with Samastipur Town P.S. Case No. 210 of 2024, registered for the alleged offences under Sections 316 (2), 318 (4), 134, 303 (2), 352, 351 (2) of BNS, 2023 and Sections 66 (C) & 66 (E) of IT Act.
3. As per prosecution case, an unknown miscreant snatched ATM card of the informant and obtained its PIN by threatening the informant with his life. Thereafter, Rs.1,60,000/- was withdrawn from the account of the informant. The name of the petitioner transpired as the accused during investigation.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

Nothing incriminating has been recovered from the person/possession of this petitioner, who was not put to any Test Identification Parade. The learned counsel further submits that after realizing that the petitioner was not the person who snatched the ATM Card and withdrew money, the informant filed a compromise petition absolving the petitioner from any wrong doing. The learned counsel further submits that the petitioner is having criminal antecedents of eight cases and he is on bail in all such cases. The petitioner is in custody since 20.11.2024 and charge sheet has been submitted.
5. Learned A.P.P. opposes the submission made on behalf of the petitioner. The learned APP submits that the petitioner appears to be habitual offender.

Having regard to the facts and circumstances and submissions made hereinabove and considering the period of custody of the petitioner and submission of charge sheet, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur, in connection with Samastipur Town P.S. Case No. 210 of 2024, subject to the conditions mentioned in Section 480

(3) of BNSS and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
