Versus
The State of Bihar .... .... Opposite Party ====================================================== Appearance :
For the Petitioner : Mr. Gyanendra Kumar Singh, Advocate For the Opposite Party : Mr. Indu Kumari Srivastav(APP) ====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 17-10-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.
The petitioner seeks to challenge an order dated 04.09.2015 by which the learned Magistrate has failed to take notice of the protest petition filed by the informant-petitioner and proceeded to take cognizance only under Sections 341 and 323/34 of the Indian Penal Code against the accused persons. Having heard learned counsel for the petitioner and learned counsel for the State, I do not find any illegality in the impugned order. However, it is open for the petitioner-informant to raise all the points placed before this court, at an inappropriate proceeding, if so advised.
Application, however, stands dismissed.
