The petitioners seek bail in Udakishunganj P.S. Case No. 06/2017, registered for the offences punishable under Sections 377/34 of the Indian Penal Code and Section 4 of the POCSO Act. The informant alleged that the petitioners committed unnatural sexual offence with Chandan Kumar and Deepak Kumar, but no external injury was found.
Learned counsel for the petitioners submits that on account of land dispute, the petitioners have falsely been implicated in the case.
It appears that the petitioners committed unnatural sexual offence with Chandan Kumar and Deepak Kumar and the
Patna High Court Cr.Misc. No.12112 of 2017 (3) dt.17-04-2017 2/2 victims under Section 164 of the Cr.P.C. reiterated the same facts. Considering the nature of allegations made against the petitioners, I am not inclined to enlarge the petitioners above named on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J.)
