NILU AGRAWAL ORAL ORDER 22-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in custody since 07.02.2017 in connection with Islampur P.S. Case No. 06/2017 for the offences alleged under Sections 25 (1-b) A/26 Arms Act. The prosecution case as lodged by the police personnel is that on a secret tip off that veteran criminal is hiding in the house of the petitioner and when the house of the petitioner was searched, a country made rifle was recovered.Accordingly, a seizure list was prepared.

It has been submitted by the learned counsel for the petitioner that he is innocent and has no criminal antecedent and

It is further submitted that no cartridge has been found either in the house and from the possession of the petitioner even the country made rifle was not recovered from the conscious possession of the petitioner. However, learned A.P.P. for the opposes the prayer for bail.

Considering the facts and circumstances and period of custody, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa , Nalanda in connection with Islampur P.S.Case No. 6/2017 .
