The petitioner is accused in connection with Mehshi P.S. Case No. 170 of 2016, registered under Section 414 of the Indian Penal Code.

The accusation is that on receiving secret information about moving of a person on motorcycle, who indulged in theft of motorcycle and withdrawn money by changing A.T.M. cards, the police started checking of vehicle. In that course, petitioner was seen on motorcycle but on seeing the police party, petitioner started to flee away but he was apprehended with Splendor Plus motorcycle bearing Registration No. JHO-B-3440 and other

Patna High Court Cr.Misc. No.6192 of 2017 (2) dt.07-03-2017 instrument, which was being used in breaking of the lock of the motorcycle, recovered from possession of the petitioner. On query, petitioner did not give satisfactory reply about keeping the seized motorcycle.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on suspicion. It is further submitted that petitioner has no criminal antecedent and is in custody since 23.10.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Motihari, in connection with Mehshi P.S.
