Heard learned counsel for the petitioner and learned counsel for the State.
Petitioner seeks bail in connection with Chiraiya P.S. Case No. 62 of 2016 registered under Sections- 387, 420/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has been implicated in the present case by the coaccused due to dirty local politics. Nothing has been recovered from the conscious possession of the petitioner. Petitioner has not been put on Test Identification Parade till date. Petitioner has no criminal antecedent and is in custody since 15.09.2016. similarly situated co-accused has been granted bail by this
Patna High Court Cr.Misc. No.7445 of 2017 (2) dt.10-03-2017 2/2 Court vide order dated 11.08.2016 passed in Cr. Misc. No. 25677 of 2016.
Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sikrahana at Dhaka, East Champaran in connection with Chiraiya P.S. Case No. 62 of 2016.
