2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 392 and 402 of the Indian Penal Code and 25 (1-b)a,/26 , 35 of Arms Act.

3. As per the prosecution case, on a secret information a raid was conducted by the patrolling party in which two persons were apprehended with some incriminating articles and they also disclosed the name of this petitioner.

4. It is submitted that the petitioner is innocent and has falsely been implicated in this case. The name of the petitioner transpired on the confessional statement of other coaccused persons. No incriminating material has been recovered

Patna High Court CR. MISC. No.15857 of 2024(2) dt.14-03-2024 2/2 from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner claims no criminal antecedent of similar nature .

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM - III , Siwan in connection with G. B. Nagar P.S. case No. 459 of 2022 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure . (Prabhat Kumar Singh, J) Koushik/- U T
