====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsels for the petitioners and the State.

Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379 and 506/34 of the Indian Penal Code.

As per prosecution case, all the F.I.R. named accused persons including these petitioners assaulted the prosecution party by means of farsa and snatched away ornaments and some cash.

Learned counsel appearing for the petitioners submits that allegation against the petitioners is general and omnibus. All the sections are bailable except Sections 307 and 379 of I.P.C. which are super addition to make the case grave.

Patna High Court CR. MISC. No.11043 of 2023(2) dt.16-05-2023 2/2 Doctor has found simple injury. Case and counter case. Petitioners have got clean antecedent.

Considering the nature of accusation and simple injury, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Shivsagar (Baddi O.P.) P. S. Case No. 534 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
