2. Petitioner seeks regular bail in connection with Bihar P. S. Case No. 291/2017 in a case registered for the offences punishable under Sections 323, 341, 307, 302, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, all the F.I.R. named accused persons are alleged to have killed the brother of informant.

4. Learned counsel for the petitioner submits that informant claims to be eye witness of the occurrence and petitioner is not named in the F.I.R. Petitioner has been made accused in this case merely on the basis of confessional statement of co-accused Sarvotam Kumar, who has already been

Patna High Court CR. MISC. No.11880 of 2025(2) dt.04-04-2025 2/2 granted regular bail by co-ordinate Bench of this Hon'ble Court vide order dated 15.01.2018 passed in Cr. Misc. No. 2627 of 2018. Petitioner is in custody since 20.09.2024.

5. Learned A.P.P. for the State vehemently opposes the bail application.

6. Considering the aforesaid facts and circumstances of the case and period of custody, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Bihar P. S. Case No. 291/2017.
