The petitioner seeks bail in (Simraha) Forbesganj P.S. Case No. 508 of 2013 dated 14.12.2013 instituted under Section 392 of the Indian Penal Code.

This is the second attempt for bail by the petitioner as earlier such prayer was rejected by order dated 17.07.2014 passed in Cr. Misc. No. 17704 of 2014.

By order dated 08.04.2016, a report was called from the Court below as to why the case had not been disposed off as per the earlier order of the Court dated 17.07.2014 in Cr. Misc. No. 17704 of

Patna High Court Cr.Misc. No.5169 of 2015 dt.18-05-2016 2/2 2014 where direction was given to conclude the trial within six months. Pursuant to the same, a report has been received from the S.D.J.M., Araria dated 18th April, 2016 in which he has prayed for grant of further time of three months to conclude the trial. In view of the aforesaid and taking into account the fact that there has been no intervening circumstances to re-consider the prayer for bail, the Court is not inclined to enlarge the petitioner on bail.

Accordingly, the application stands dismissed. However, the Court below is directed to ensure that the trial is concluded latest by 31st August, 2016. It is indicated that since this Court has allowed time in terms of the request made by the Court below itself, it shall be the duty of the Court to ensure that the trial is concluded within the timeframe fixed.
