This application is for modification in order dated 20.12.2021 passed in Cr. Misc. No.39797 of 2021 by a Coordinate Bench of this Court, granting bail to the petitioner and surrender before the court below within a period of thirty days from the date of receipt of the order but the petitioner could not surrender due to the shifting of record from the Patna District Court to Civil Court, Patna City took some time and the next date in surrender-cum-bail application was fixed on 27.01.2022 and the Special Judge Excise, Patna City has gone for training, as such he could not furnish the bail bond within the stipulated
Patna High Court CR. MISC. No.11867 of 2022(2) dt.07-04-2022 2/2 period.
In that view of the matter, order dated 20.12.2021 passed in Cr. Misc. No. 39797 of 2021 is modified to the extent that the petitioner is directed to surrender before the court of learned Special Judge, Excise, Patna within a period of four weeks from the date of this order in connection with Fatuha P.S.Case no.922 of 2020 and remaining parts of order dated 20.12.2021 shall remain intact.
