JUSTICE DINESH KUMAR SINGH ORAL ORDER 30-01-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 345/34 of the Indian Penal Code.
The accusation is of outraging the modesty of the informant.
It is submitted by the learned counsel for the petitioners that for the alleged occurrence of 15.6.2015 at 9 P.M. the FIR was registered on 25.6.2015. The accusation has been levelled in the background of Title Suit No. 467 of 2014 pending between the father in law of the informant and the petitioners. The petitioners and their father Banarsi Singh were assaulted at the hands of the
Patna High Court Cr.Misc. No.4195 of 2016 (2) dt.30-01-2016 2/2 informant's family when Bhabhua P.S. Case No. 411 of 2015 was lodged by the father of the petitioners levelling accusation under sections 447,411,323,504,506 and 307/34 IPC.
Considering the delayed lodging of the case and the accusation being levelled in the background of litigated relationship, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Bhabua, Kaimur in connection with Bhabua (Mahila ) P.S. Case No.32 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
