JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2017 Heard learned counsel for the petitioner, and the learned counsel representing the State.

The petitioner apprehends his arrest in connection with Riga P.S Case No. 253 of 2015 registered for the offence punishable under Section 364/34 of the Indian Penal Code. The First Information Report is against four unknown. During investigation one Ramjee Rai was arrested and he confessing his guilt stated the name of the petitioner as well as others and similarly situated co-accused Pushpam Kumar has been allowed pre-arrest bail, whereas, Ramjee Rai has been allowed regular bail by another Bench of this Court.

Learned A.P.P. fairly submits that similarly situated co-accused persons were allowed pre-arrest bail.

No.19122 of 2017 (2) dt.25-05-2017 2/2 In the facts and circumstances stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of the order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S. Case No. 253 of 2015 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
