Mr. Pramod Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 12-09-2022 Heard learned counsel for the petitioners and the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 341, 323, 365, 511, 379, 343, 504, 506/ 34 of the Indian Penal Code and Section 25(1-b) of the Arms Act.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and the informant alleges that on 23.12.2020 at about 2.30 P.M., when he along with his cousin had gone to the market and when they reached near Karturwa school, they were intercepted by nine named accused persons including the petitioner, who kidnapped

Patna High Court CR. MISC. No.11101 of 2022(2) dt.12-09-2022 2/3 him and took him to village Dhaukal Bigha. It is next alleged that Binod Kumar tied the informant around a tree. Thereafter, Sunil Kumar assaulted him with butt of pistol causing injury on his lips and the accused persons snatched Rs.5,000/- and some valuables from his pocket when police arrived, he was saved. The learned counsel for the petitioners submits that the petitioners have been falsely implicated in the present case. It is next submitted that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that no specific allegation has been alleged against the petitioners though allegation of assault is against Sunil Kumar and of tying the informant around a tree is against Binod Kumar. The learned Additional Public Prosecutor opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Atri P. S. Case

The application stands allowed.
