The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 420 of the Indian Penal Code.

Allegation against the petitioner is that six cheques amounting to Rs. 30,00,000/- which were issued in favour of the informant were returned without encasement by the Bank through endorsement that funds were insufficient. It is submitted by learned counsel for the petitioner that petitioner is innocent and has been falsely implicated in this case. He submits that he partly complied the order dated 29.09.2021. Learned counsel further submits that uptill now he returned Rs. 9,00,000/- (nine lakh) to the

Patna High Court CR. MISC. No.14241 of 2020(10) dt.28-06-2022 2/2 informant and further prays for six months time to pay remaining amount to the informant.

Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on provisional bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 1910 (c) of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

The learned court below will confirm the bail bond of the petitioner on submission of the receipt of payment of remaining amount on affidavit before the learned court below. If the petitioner fails to deposit the remaining amount within the stipulated period, the informant will be at liberty to file an application for cancellation of the bail bond of the petitioner.
