The petitioners apprehend their arrest in a case registered for the offence under Sections 304(B)/201/34 of the Indian Penal Code.
It is a case of dowry death. The allegation against petitioners is that they alongwith co-accused Manoj Kumar Yadav (husband) committed the murder of sister of the informant due to non-fulfillment of demand of dowry. Petitioner no. 1 is Bhaisur, petitioner no. 2 is married Nanad and petitioner no. 3 is Gotini of the deceased.
It is submitted on behalf of petitioners that thrust of
Patna High Court CR. MISC. No.11516 of 2022(2) dt.11-08-2022 2/2 the accusation is against husband of the deceased, who is already in custody. There is no specific allegation of demand of dowry, torture and cruelty against these petitioners. Petitioners are separate in mess and property and have got no concern with the family affairs of couple (deceased and her husband). Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Masaurhi, District - Patna in connection with Bhagwanganj P.S. Case No. 98 of 2020, corresponding to G.R. No. 788 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
