The petitioner seeks bail in connection with Special Case No.43/16 registered under Sections 272, 273/34 of the Indian Penal Code, 27(B),28 of the Drugs and Cosmetic Act, 22(B) of N.D.P.S.Act and 30/38 of Bihar Prohibition and Excise Act. The accusation is that in course of checking one cartoon was being loaded in Santro Car taking from Tempo. On search of cartoon 160 bottles of Eskuf Cough Syrup was recovered from the cartoon by the police party and the petitioner was found at the driving seat of the Santro car.

Learned counsel for the petitioner submits that the petitioner has no concern with the cartoon containing 160 bottles

Patna High Court Cr.Misc. No.12191 of 2017 (2) dt.17-03-2017 2/2 of cough syrup and on suspicion he is in custody since 09.12.2016. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned District & Sessions Judge -cum- Special Judge, Araria, in connection with Special Case No.43/16 arising out of Araria (R.S) P.S.Case No.835/16.
