2. The petitioner seeks bail in connection with Hisua P.S. Case No. 529 of 2024 dated 06.09.2024, instituted for the offence punishable under Sections 191(2), 191(3), 190, 131, 109, 61(2), 111(3) of the B.N.S. and u/s 25(1-b)(a)/26/27/35 of the Arms Act.

3. The prosecution case, in short, on the alleged date of occurrence, the petitioner and other accused persons were allegedly making firing in village Latawar for purpose of creating terror amongst the villagers on the pretext that villagers have played the role of spy as a result his four tractors were seized by Mining officials. 4. Learned counsel for the petitioner submits that the petitioner in innocent and has falsely been implicated in the present case. No incriminating material has been recovered from the possession of this petitioner and no one has sustained any firearm injury. He further submits that after completion of investigation, charge-sheet has been submitted against the petitioner. Petitioner is in custody since 28.12.2024.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawadah in connection with Hisua P.S. Case No. 529 of 2024, subject to the following conditions :- (i). One of the bailors should be close relative of the petitioner.

(ii). Petitioner shall co-operate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, their bail bonds may
