JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-02-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 461, 379, 34 of the Indian Penal Code.

The theft was committed in the mobile shop of the informant when he came to know that the theft was committed by Lorik Mushar. On the confession of co-accused Lorik Mushar the name of the petitioner sprang up. It is submitted by learned counsel for the petitioner that except confession of the co-accused, there is nothing against the petitioner. Moreover, for the occurrence of 12.12.2015, the First Information Report was registered on 14.12.2015 and the petitioner is next door neighbour of the informant.

The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioner

Patna High Court Cr.Misc. No.4924 of 2016 (2) dt.05-02-2016 2/2 surrenders within a period of six weeks in connection with Bhabua P.S. Case No. 701 of 2015, pending in the Court of learned Chief Judicial Magistrate, Kaimur at Bhabua. With the observations above, the application stands disposed off.
