The petitioner seeks bail in connection with Gurua P.S. Case No. 67 of 2019, registered under Section 379 of the Indian Penal Code.

Submission is that it would appear from the first information report that the petitioner is not named in the first information report, as on the basis of the fardbeyan of informant, Vigan Ravidas, Gurua P.S. Case No. 67 of 2019, regarding the theft of the motorcycle.

In course of investigation, the stolen motorcycle recovered from the house of Sunil Sao, who confessed his guilt saying that the said motorcycle was sold by petitioner and one Gautam Kumar. Except the confessional statement, no tangible material has been collected by the investigating officer showing

Patna High Court CR. MISC. No.9911 of 2020(2) dt.29-02-2020 2/2 the involvement of the petitioner. Further, submission is that the petitioner is accused in three cases, as detailed in paragraph 3 of the petition, due to that reason, the police implicated the petitioner showing his involvement.

Sri Md. Javed Jafar Khan, learned counsel for the petitioner, submits at Bar that in the three cases, as detailed in paragraph 3, the petitioner is on bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Gurua P.S. Case No. 67 of 2019 to the satisfaction of the Subdivisional Judicial Magistrate, Sherghati, Gaya.
