The petitioner seeks bail in Kuchaikote P.S. Case No. 272/2016, registered for the offences punishable under Section 414 of the Indian Penal Code.

It is alleged that the petitioner after seeing the police fled away leaving the motorcycle on the road, but petitioner was apprehended.

Learned counsel for the petitioner submits that the petitioner was standing by the side of road to catch the bus and he has falsely been implicated in the case. The petitioner has got no history of such cases of committing theft or keeping any stolen article. No case is reported about the theft of the recovered motorcycle. The petitioner is in jail since 12.12.2016.

Patna High Court Cr.Misc. No.12574 of 2017 (2) dt.28-03-2017 Considering the facts aforesaid and the fact that petitioner has remained in jail for more than three and half months, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-VII, Gopalganj in connection with Kuchaikote P.S. Case No. 272/2016.
