JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Kahalgaon (Ghogha) P.S. Case No. 473 of 2018, G.R. No. 3316 of 2018 for the offenses under Sections 25(1-b)a, 26, 27, 35 of the Arms Act.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. It is alleged that petitioner was involved in firing in a gang rivalry and from the possession of the petitioner one country made loaded pistol was recovered. The petitioner is in custody since 16.7.2018. Considering the period of custody and the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.10813 of 2019(2) dt.22-02-2019 2/2 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Kahalgaon (Ghogha) P.S. Case No. 473 of 2018, G.R. No. 3316 of 2018.
