The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 419, 420/34 of the Indian Penal Code and sections 66(B)/66(D) of the Information Technology Act, 2020.

As per the prosecution case, all the FIR named accused persons induced the public and cheated them by offering high interest rate on their deposit. During course of search, from the house of co-accused Kundan Kumar, mobile phones, pass-book of Gramin Bank, customers' details sheet were recovered.

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired during course of investigation on the basis of confessional statement of co-accused. No

Patna High Court CR. MISC. No.10950 of 2022(2) dt.08-08-2022 2/2 incriminating article has been recovered from possession or from the premises of the petitioner. Petitioner has got clean antecedents.

Considering the aforesaid facts & circumstances, the petitioner above-named, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Warisaliganj P.S. Case No. 224 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
