JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 302 and 120B/34 of the Indian Penal Code.
The prosecution case is that the petitioner, her husband and others indiscriminately assaulted the father of the informant namely Upendra Das who succumbed to the injuries since the victim failed to cure the petitioner.
It is submitted by the learned counsel for the petitioner that the informant is not the eye witness to the occurrence and maliciously the accusation has been levelled since the petitioner was a sick lady. The thrust of accusation is against her husband who has been chargesheeted along with Bijendra Das and the
Patna High Court Cr.Misc. No.4083 of 2016 (2) dt.29-01-2016 2/2 investigation is pending against the petitioner. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Murliganj P.S. Case No. 171 of 2014 pending in the court of learned A.C.J.M. Madhepura.
This application is disposed of with the aforesaid observation/direction.
