2. The petitioner has preferred this application for grant of regular bail in connection with Sarairanjan P.S. Case No. 315 of 2023 dated 10.11.2023 registered for the offences punishable u/ss 147, 148, 149, 341, 342, 323, 324, 325, 307, 379, 504, 506 of the Indian Penal Code.
3. As per the prosecution case, the petitioner and the other accused persons are alleged to have assaulted the informant's son. On protest by the informant, they also started abusing and assaulting him. The petitioner assaulted on the head of the informant's son with lathi-danda causing injury. The coaccused, Amarjeet Sahni and Sanjeet Sahni also assaulted his

The other accused persons also assaulted his son with fist and slaps. The accused persons also assaulted the informant with an iron rod and slammed him on the ground due to which he became senseless and fell down on the ground. It is further alleged that the accused persons snatched the gold chain of Rs. 1,50,000/-, cash of Rs. 1200/-, mobile phone and motorcycle.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a case and counter case between the parties. Nothing has been recovered from the conscious possession of the petitioner. As per the injury report of the injured Abhay Kumar, he sustained four multiple injuries in which one injury is grievous in nature which is on non vital part of the body and the other injuries are simple in nature. The co-accused person has already been granted regular bail by this court vide order dated 15.07.2024 passed in Cr. Misc. No. 44868 of 2024. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 11.11.2023.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Samastipur in connection with Sarairanjan P.S. Case No. 315 of 2023.
7. The application stands allowed.
