JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-01-2021 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State. The petitioner apprehends arrest in a case registered for the offence punishable under section 353, 504 and other ancillary sections of the Indian Penal Code.

Prosecution's case, in brief, is that 16 named and about 40 to 50 unknown persons had blocked the road in protest of an incident in which a bus staff had assaulted a tempoo driver.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The allegation is general and omnibus in nature and there is no allegation that the petitioner committed any violent act.

Patna High Court CR. MISC. No.11044 of 2020(3) dt.04-01-2021 2/2 Similarly situated several co-accused have already been allowed bail by different co-ordinate bench of this Court vide order dated 3.3.2020, passed in Cr.Mis.No. 8594/2020. Petitioner has got no criminal antecedent.

In the facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri MK Pandey, Judicial Magistrate 1st class, Jamui in Barhat Police Station Case No. 52 of 2019, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
