JUSTICE ARUN KUMAR ORAL ORDER 15-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is in custody in connection with Rail Siwan P.S. Case No. 85 of 2016 registered under section 30(A) of the Bihar Excise (Amendment) Act, 2016.

Prosecution case is that 40 bottles of foreign liquor each containing 180 ml. was recovered from his bag. It is submitted that there is no recovery from the possession of the petitioner. Even a copy of the seizure list was not handed over to him and this petitioner has got no criminal antecedent.

Considering the said facts and circumstances, the petitioner, namely, Jitendra Kumar Gupta is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with
