The petitioner seeks bail in Dhanaha P.S. Case No. 168 of 2018, instituted for the offence under Section(s) 363, 366, 366(A) and 120(B)/34 of the Indian Penal Code. It is alleged in the written report that petitioner has kidnapped minor daughter of the informant with purpose to perform marriage.
The victim girl on recovery has given statement under Section 164 Cr. P.C. wherein she has stated that she had voluntarily left her house and gone to Gorakhpur. She has not been kidnapped by anyone. She has further stated in her statement recorded under Section 164 Cr. P.C. that she does not want to go to her parent's house because she has apprehension
Patna High Court CR. MISC. No.11447 of 2019(2) dt.26-02-2019 2/2 that her family members will commit her murder. Petitioner is in custody since 5.9.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bagaha, West Champaran, in connection with Dhanaha P.S.
