JUSTICE PRABHAT KUMAR JHA ORAL ORDER 25-02-2019 Heard the learned counsel for the petitioner, the learned Additional Public Prosecutor for the State as well as the learned counsel appearing on behalf of the complainant. Petitioner apprehends his arrest in Complaint Case No. C 781 of 2017 for the offences allegedly committed by the petitioner under Section 498(A) of the Indian Penal Code. Learned counsel for the petitioner submits that there is omnibus and general allegation of demand of dowry and torture. Petitioner is living in Delhi. Petitioner is ready to keep his wife. Learned counsel for the complainant also submits that the wife has got a four years' son in her lap and she is ready to live with her husband.

No.11145 of 2019(2) dt.25-02-2019 2/2 Taking into consideration the facts that husband and wife are willing and ready to resolve their disputes after sinking their differences, the petitioner, above named, is directed to surrender in the court below within four weeks from the date of receipt of this order and on such, the learned court below shall enlarge the petitioner on provisional bail for four months on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Kishanganj in connection with Complaint Case No. C 781 of 2017. Thereafter the learned court below shall make efforts to resolve the dispute between husband and wife. If the petitioner-husband keeps his wife and son properly, the provisional bail granted to the petitioner shall be confirmed. If the petitioner fails to keep his wife and son properly, the learned court below shall pass order on provisional bail of the petitioner immediately after lapse of four months.
