JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 This application, for grant of anticipatory bail, arises out of Akbarpur P.S. Case No. 168/2018, disclosing offences under Sections 30(a) of Bihar Prohibition and Excise Act, 2016. Allegation is of recovery of 4077 litres of Indian made foreign liquor from the truck and it is alleged that the said liquor belonged to co-accused Gajadhar Manjhi, Bisheshwar Manjhi and Maheshwar Manjhi and name of the petitioner also surfaced in this case during course of investigation. Submission of learned counsel for the petitioner is that his name has falsely been dragged in this case during course of enquiry after four months and the petitioner has nothing to do with the alleged recovery and nothing has been recovered from the petitioner. Further submission is that though he is accused in one more case but that is not of similar nature as the present

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II- cum- Special Judge, Nawada, in connection with Akbarpur P.S. Case No. 168/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
