The petitioners apprehend their arrest in connection with Barhara P.S. Case No.195 of 2015 for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 447, 506 and 436 of Indian Penal Code and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. Mr. Gyanand Roy, learned counsel for the petitioners with reference to the F.I.R. present at Annexure-1 submits that the alleged F.I.R. is an outcome of the land dispute and the allegations are omnibus and general in nature.
Having heard learned counsel for the parties and considering the omnibus nature of allegation present in the F.I.R., let the petitioners namely, (1) Jageshwar Mandal, (2) Rameshwar
Patna High Court Cr.Misc. No.4835 of 2016 (2) dt.16-03-2016 2/2 Mandal, (3) Subodh Mandal and (4) Niro Mandal in the event of their arrest/surrender within four weeks from today, be released on bail upon furnishing individual bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Purnea in connection with Barhara P.S. Case No. 195 of 2015 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
