====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2023 Heard learned counsels for the petitioners and the State.
Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 342, 509, 354, 354(B), 504, 506/34 of the Indian Penal Code and Section 8/12 of the Protection of Children from Sexual Offences Act. Petitioner No. 1 is alleged to have molested the daughter of the informant and petitioner No. 2, who is mother of petitioner No. 1, is alleged to have abused and ousted her from the house.
Learned counsel appearing for the petitioners submits that due to petty dispute, quarrel took place between the
Patna High Court CR. MISC. No.10641 of 2023(2) dt.16-05-2023 2/2 parties and taking advantage of the same, this false and concocted case has been lodged against the petitioners. Moreover, the matter has been compromised between the parties. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, this anticipatory bail is allowed and it is ordered that the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Exclusive Special Judge-POCSO-cum-Additional District and Sessions Judge-VII, Gaya in connection with Alipur P. S. Case No. 141 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
