The petitioner is accused in connection with Complaint Case No. 516 of 2009/ Tr. No. 268 of 2016 registered under Section 498A of the Indian Penal Code.
Learned counsel for the petitioner submits that, in fact, petitioner was allowed anticipatory bail on 06.09.2011 vide Criminal Misc. No. 27252 of 2011 by a Bench of this Court with direction that petitioner will pay a sum of Rs.2000/- per month to the complainant-opposite party no. 2 by way of interim maintenance, subject to any order on the point by the competent
Patna High Court Cr.Misc. No.15091 of 2017 (2) dt.26-04-2017 court and the petitioner paid maintenance about one year after passing of said order but due to financial crisis petitioner could not pay the maintenance amount. Thereafter, bail bond of the petitioner was cancelled and subsequently he was remanded in the present case on 30.12.2016. Further submitted that petitioner is aged about 70 years.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Aurangabad (Bihar) in connection with Complaint Case No. 516 of 2009/ Tr. No. 268 of 2016. Out of two sureties, one surety must be the close relative of the petitioner.
