Petitioner prays for grant of regular bail in connection with Kashim Bazar P.S. Case No.224/2020, registered for the offence u/s 25 (1-A) (25-1AA) 25(1-b)a, 26(i)(ii)/35 of Arms Act pending before the learned C.J.M., Munger. Vide order dated 13.09.2021, a report was called for from the court concerned regarding the bail granted to the petitioner from the learned court below.
In compliance thereof, a report at Flag 'R' dated 22.09.2021 has been sent by the learned District and Sessions Judge-I, Munger whereby it has been submitted that in the bail petition vide B.A. No.330/2021 at para-2, this petitioner has
Patna High Court CR. MISC. No.21506 of 2021(3) dt.25-10-2021 2/2 given a certificate which is reproduced here: "Earlier B.A. No.1837/2020 has been filed on behalf of the petitioner and the same was dismissed and thereafter, no bail application, either regular or anticipatory is pending before this court or any other superior court."
Considering the submissions made in the report, it is clear that petitioner has suppressed this fact that he has filed the present bail application before the Patna High Court. The learned trial court is directed to take steps for cancellation of the bail bonds of the petitioner and thereafter, inform this Court about the same.
