1. Heard the parties.

2. The petitioner has filed the present writ application seeking a direction to the respondent to appoint the petitioner as primary teacher as he was selected candidate after final counseling in Block Runnisaidpur, Sitamarhi.

3. Learned counsel for the State submits that the matter related to appointment and other service condition of primary teacher in Panchayat/Block under Rule 18 of the 2012 Rule is appealable before the District Teachers Appellate Authority which is functioning in the district of Sitamarhi. The

Patna High Court CWJC No.2658 of 2023(2) dt.11-12-2023 2/2 petitioner may be relegated before the Appellate Authority for redressal of his grievance.

4. In view of the aforesaid submission, the present writ application is disposed with a liberty to the petitioner to file an appeal before the District Teachers Appellate Authority within a period of one month and if such an appeal is filed along with condonation of delay petition, the Appellate Authority shall decide the same in accordance with law within a reasonable time period.
