JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 458/380/401/411 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016.

The petitioner was arrested on the statement of co-accused.

Submission is that nothing was recovered from the possession of this petitioner and he is in custody since 18.06.2016.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.12876 of 2017 (2) dt.21-03-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur/Successor Court, in connection with Mushahari P.S. Case No.80 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
