The petitioner is languishing in custody since 07.11.2018 in a case registered for the offences punishable under Sections 414, 379/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that from the possession of the petitioner and co-accused Deepak Kumar, one stolen motorcycle was recovered and from the fast food stall of the co-accused of Deepak Kumar, two bottles of Indian made foreign liquor of 180 ml each were recovered.

It is submitted by learned counsel for the petitioner that the petitioner only took ride of the on the alleged motorcycle of the co-accused Deepak Kumar. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal

Learned APP submits that the recovery has been made from the petitioner and co-accused Deepak.

Considering the quantity of recovery and the period under custody, coupled with the statement made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II -cum- Special Judge, Vaishali at Hajipurin connection with Desri P.S.
