The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. As per the F.I.R, the informant has alleged that all the accused persons assembled and started her husband assaulting by means of stick and lathi. The further specific allegation against Sanju Kumar @
Patna High Court CR. MISC. No.14325 of 2023(3) dt.24-06-2023 2/3 Sanjeet, Ajeet Kumar and Subhash who are alleged to have shot injuries to her husband, who succumbed to his injuries on the spot itself.
It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The specific accusation of shot fire is against Sanju Kumar, Ajeet Kumar and Subham. Moreover, other co-accused have been granted bail by a coordinate Bench of this Court vide order dated 11.08.2022 passed in Cr. Misc. No. 25490 of 2022. The petitioner is languishing in custody since 30.09.2022.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Dulhin Bazar
