The petitioner apprehends his arrest in connection with Sahar P.S. Case No. 235 of 2019 for the offence registered under Section 420 of the Indian Penal Code. The allegation is regarding the petitioner having introduced the co-accused persons to the Ex-Mukhiya and thereafter it appears that the said Ex-Mukhiya had given some money to the other persons who are stated to have been introduced by the petitioner and subsequently the said coaccused person had fled away with the money of the ExMukhiya. The learned counsel for the petitioner submits that there is no allegation of the petitioner having embezzled any

Patna High Court CR. MISC. No.8881 of 2020(2) dt.29-02-2020 2/2 money of the Ex-Mukhiya or others or having any role which is apparent from a bare perusal of the FIR. It is further submitted that the petitioner is innocent and he is having a clean antecedent.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail. Accordingly, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Sahar P.S. Case No. 235 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
