The petitioner is in custody in connection with Lodipur Case No.110 of 2016 registered for an offence under Section 30(a) of the Bihar Excise (Amendment) Act, 2016.

The police team in course of patrolling duty seized a motorcycle on which two persons were found carrying foreign liquor. Police recovered 36 bottles of liquor each of 750 ml. kept in a bag belonging to the petitioner.

Learned counsel for the petitioner submits that the one another co-accused is enjoying the privilege of bail granted by this Court vide Cr.Misc.No.54676 of 2016. The petitioner is in custody since 22.10.2016.

However, learned APP opposed the prayer for bail.

Patna High Court Cr.Misc. No.6032 of 2017 (2) dt.01-03-2017 2/2 Considering the nature of allegation, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM-IV, Bhagalpur in connection with Lodipur P.S. Case No.110 of 2016.
