The petitioner seeks regular bail in connection with Patrakar Nagar PS case no. 723 of 2018 registered for the offence punishable under Sections 20, 22, 24 of Narcotic Drugs and Psychotropic Substance Act.

The allegation is regarding recovery of one sachet containing one gram of brown sugar from the pocket of the petitioner herein.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and in any view of the matter, 5gms. of Heroine has been classified as small quantity in the Schedule to the Narcotics

Patna High Court Cr.Misc. No.9995 of 2019(2) dt.19-02-2019 2/2 Drugs & Psychotropic Substance Act, 1985, whereas the recovery from the petitioner is much less than that, hence there is no impediment in releasing the petitioner on regular bail. It is further submitted that the petitioner is having clean antecedent and he is languishing in custody since 05.12.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the abovenamed petitioner is directed to be enlarged on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Patrakarnagar PS case no. 723 of 2018.
