The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 342, 365, 323, 380, 494, 504 and 506/34 of the Indian Penal Code. It is a case of assault and giving threatening to the complainant by the petitioner and other accused persons. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that there is dispute between the husband and wife and many litigations are pending between them. It is admitted by the petitioner that he has solemnized second marriage with another lady, namely, Puja Kumari, due to this some altercation occurred
Patna High Court CR. MISC. No.10933 of 2022(2) dt.30-08-2022 2/2 between the complainant and the petitioner.
However, learned APP for the State opposed the anticipatory bail of the petitioner.
Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Lakhisarai in connection with Mahila P.S. Case No. 03 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
