2. The petitioner is apprehending arrest in connection with Jamalpur (Bargaon) P.S. Case No. 121 of 2023 instituted under Sections 302, 328 and 201/34 of the Indian Penal Code lodged on 20.9.2023 by the informant, Md. Danish.
3. As per the prosecution story, the informant alleged that the lady was married to one Md. Hamid @ Tafali but was always tortured for dowry, in between, she was also blessed with two children on. On 13.9.2023, when the informant went to the lady's in laws' house did not find her sister, later, came to know that she has been poisoned to death. Accordingly, the FIR.
4. Learned counsel for the petitioner submits that she is maternal sister-in-law, is a student, not residing in that home, only because she belongs to the family, implicated.
5. Learned APP opposes the prayer for anticipatory
Patna High Court CR. MISC. No.14020 of 2024(2) dt.12-03-2024 2/2 bail.
6. Taking into account the fact that the girl is 19 years of age, do not have criminal antecedent, is a maternal sister-inlaw, this Court is inclined to extend her privilege of anticipatory bail.
7. Let the petitioner be released on bail, in the event of her arrest or surrender before the subordinate court within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each in connection with Jamalpur (Bargaon) P.S. Case No. 121 of 2023 to the satisfaction of learned J.M.-1st Class, Biraul, Darbhanga subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also the other conditions. (i) one of the bailor should be the family member of the petitioner who shall provide official document to show his/her bona fide;
(ii) the petitioner shall co-operate in the investigation and make herself available to the police as and when required; (Rajiv Roy, J) Ravi/- U T
