The petitioner is accused in connection with Banka P.S. Case No. 336 of 2007 (G.R. Case No. 1587A of 2007) registered under sections 457 and 380 of the I.P.C. pending in the Court of S.D.J.M., Banka.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Further submission is that nothing has been recovered from the possession of the petitioner. Petitioner is in custody since 27.10.2019.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner is named in the first information report. On perusal of

Patna High Court CR. MISC. No.12299 of 2020(2) dt.29-02-2020 2/2 the F.I.R., it is apparent that the petitioner was seen fleeing away along with others accused persons. Further he submits that the petitioner was absconder since long.

Having considered the above facts and circumstances of the case and nature of allegation, this Court is not inclined to allow the prayer of the petitioner for bail. Accordingly, prayer for grant of regular bail of the petitioner is rejected.

However, liberty is granted to the petitioner to renew his prayer for bail after framing of charge. (Arvind Srivastava, J) shailendra/- U T
