The petitioners seek bail in Amour P.S. Case No. 06/2017, registered for the offences punishable under Section 273 of the Indian Penal Code and Section 30 of Bihar Prohibition & Excise Act.
The police raided a field behind the house of the petitioners on information that Mahesh Kumar, his father and others had kept foreign liquors, made in West Bengal. After search, 132 bottles of country made foreign liquor were recovered from possession of the petitioners, namely Mahesh Kumar and Rupesh Kumar.
It is submitted that the petitioners are in jail since
Patna High Court Cr.Misc. No.10986 of 2017 (2) dt.07-03-2017 2/2 17.01.2017 and they have got no criminal antecedent. The petitioners have already remained in jail for about one and half months.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Purnea in connection with Amour P.S. Case No. 06/2017.
