2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 127(2), 75 of the BNS Act and Sections 3, 4, 5 and 7 of the Immoral Trafficking Act.
3. As per prosecution case, on information that sexual activities were carried out, a raid was conducted and boys and girls were found in objectionable condition in the cabin of Plan B Restaurant. Condoms and condom wrapper were recovered.
4. It is submitted that the petitioner is innocent and has been falsely implicated in this case only because he is manager of the restaurant which is a public place. The boys and girls who were arrested are major. The restaurant of petitioner is open for all and if adults come, they cannot be stopped to have food. Petitioner is running the said restaurant
Patna High Court CR. MISC. No.11011 of 2025(2) dt.25-02-2025 2/2 from last one year. The present case has been instituted because of business rivalry. Petitioner has antecedent of one criminal case
5. Learned counsel for the State opposes the bail petition.
6. Considering the facts of the case, clean antecedent of the petitioner, in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JMFC, Bhagalpur in connection with Habibpur P.S. Case No. 243 of 2024 in connection with B, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Prakash/- U
