This is a petition for grant of anticipatory bail for offence under Section 47(a) of the Excise Act. In the year 2015, fifteen liters of liquor was allegedly recovered from the shop of the petitioner. Submission of the petitioner is that false allegation is there and the petitioner was not available at the time of alleged recovery.
Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Excise Case No. 1 of 2016 to the
Patna High Court Cr.Misc. No.18610 of 2017 (2) dt.27-04-2017 2/2 satisfaction of the Subdivisional Judicial Magistrate, Raxaul at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
