====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2019 Heard learned counsel for the petitioner and the State.

This application has been filed for modification of the order dated 23.07.2018 passed in Cr. Misc. 43976 of 2018. Counsel for the petitioner submits that petitioner was granted anticipatory bail by this Court by aforesaid order in which he was directed to surrender in the Court below within a period of six weeks from the date of order, but he could not surrender in the court below within stipulated time because he did not get leave from his employer. He is working in Santnagar Burari at Delhi as labourer in construction company and due to non-payment of his wages and leave, he could not come to his native village to surrender in the court below. The prayer has

This modification application is allowed with direction to petitioner to surrender in the court below within six weeks from the date of receipt/production of a copy this order. In the event petitioner surrenders in the court below within aforesaid period, he will be released on same terms and conditions as mentioned in the order dated 23.7.2018 passed in Cr. Misc. 43976 of 2018.

Let this order be communicated to the learned Chief Judicial Magistrate, Banka, in connection with Rajoun P.S. Case No. 598 of 2017.
